Google, ITA, Travel, Privacy and also Competition

Travel is a major part of the online marketing industry.  But it has lots of privacy concerns–who knows where you plan to go, spend time [in the exact location via geomapping, etc], how much money you generally spend, with your family or on business, etc.  There are a host of civil liberties issues related to commercial and government access to this data.   That’s one of the reasons why competition and privacy regulators around the world should closely critically analyze the proposed Google acquisition of travel information leader ITA Software.

Google is currently expanding its online travel advertising business–and swallowing ITA will undoubtedly boost its market share–and give it access to reams of additional data on consumers and business practices.  For example, in its Seattle regional office, Google is hiring several marketing specialists, including:


*Display Account Manager, Travel:  [“As a Display Account Manager, you’ll sell and manage advertising for the sixth-largest media property in the world and other Google display offerings. You will be a part of the team on the cutting edge of interactive marketing and media. You will drive the online video marketplace forward and engage advertising agencies and brand marketers in programs that move the needle for their companies. The primary responsibility of the Display Account Manager is to drive new business revenue for YouTube and other Google display services and products with Fortune 1000 advertisers across multiple industries.”]   They also want an Account Manager, Travel Vertical and a Display Account Executive, Travel.  Other travel online ad sales jobs are posted for London [“As a Google Industry Manager, Travel you will be working with clients to provide digital solutions for sales & marketing objectives via a variety of Google’s Search, Display and Tools. This job is a mix of finding and managing new and existing business customer relationships, and working closely with the Industry Head to develop Google’s marketplace in the Travel sector. You’ll combine digital media and deep commercial knowledge with strong presentation and communication skills. You’ll own the relationships with clients and agencies, targeting, educating and developing new clients to grow the business in unpenetrated territory.”]; Australia [Account Strategist, Travel Industry].  Plus its DoubleClick division performs travel related online marketing work.  Of course, given Google’s recently expanded role providing mobile ad targeting, via its Admob acquisition, related privacy and competition issues are also raised.

MicroHoo & Digital Data Consolidation: Despite DoJ okay, FTC Needs to Act and Protect Consumer Privacy

Today’s announcement that Microsoft and Yahoo have received clearance from the DoJ and EU to proceed with its partnership continues the global trend towards online marketing consolidation.  Given Google’s dominance in search, the Microsoft `helps save Yahoo deal’ creates what some hope will be more robust competition in the search market.  But the real issue with the deal is data privacy.  That’s why the Federal Trade Commission needs to dig into this new partnership and ensure consumer privacy is protected.

Consumer and Privacy Groups at FTC Roundtable to Call for Decisive Agency Action

Washington, DC, December 6, 2009 – On Monday December 7, 2009, consumer representatives and privacy experts speaking at the first of three Federal Trade Commission (FTC) Exploring Privacy Roundtable Series will call on the agency to adopt new policies to protect consumer privacy in today’s digitized world. Consumer and privacy groups, as well as academics and policymakers, have increasingly looked to the FTC to ensure that Americans have control over how their information is collected and used.

The groups have asked the Commission to issue a comprehensive set of Fair Information Principles for the digital era, and to abandon its previous notice and choice model, which is not effective for consumer privacy protection.

Specifically, at the Roundtable on Monday, consumer panelists and privacy experts will call on the FTC to stop relying on industry privacy self-regulation because of its long history of failure. Last September, a number of consumer groups provided Congressional leaders and the FTC a detailed blueprint of pro-active measures designed to protect privacy, available at: http://www.democraticmedia.org/release/privacy-release-20090901.

These measures include giving individuals the right to see, have a copy of, and delete any information about them; ensuring that the use of consumer data for any credit, employment, insurance, or governmental purpose or for redlining is prohibited; and ensuring that websites should only initially collect and use data from consumers for a 24-hour period, with the exception of information categorized as sensitive, which should not be collected at all. The groups have also requested that the FTC establish a Do Not Track registry.

Pam Dixon, World Privacy Forum: “Self-regulation of commercial data brokers has been utterly ineffective to protect consumers. It’s not just bad actors who sell personal information ranging from mental health information, medical status, income, religious and ethnic status, and the like. The sale of personal information is a routine business model for many in corporate America, and neither consumers nor policymakers are aware of the amount of trafficking in personal information. It’s time to tame the wild west with laws that incorporate the principles of the Fair Credit Reporting Act to ensure transparency, accountability, and consumer control.”

Progress & Freedom Foundation Comes to Aid of Comcast/NBCU Deal [But Doesn’t Say it’s Funded by both Comcast and NBCU!]

Progress and Freedom Foundation’s Ken Ferree issued a press release today that, amazingly, claimed “the deal raises no general antitrust or diversity issue.”  But there was not a word or mea culpa that his salary is partly paid for by PFF’s supporters Comcast, NBCU and the cable industry.  Beyond the conflict question, there is also Mr. Ferree’s peculiar history with media consolidation.  He was Michael Powell’s chief staffer when the FCC tried to end all the media ownership safeguards.  Powell and his allies failed then to understand the complexities of the issue, which resulted in a huge public and political backlash.  It appears it’s rerun time!

Comcast’s Pathetic “Public Interest” Commitments to Regulators for its NBCU Deal

Comcast released a memo this morning summarizing what it will promise regulators in order to win approval of its NBCU mega-deal with GE.   It’s a laughable document that demonstrates a cable monopolist mentality.  As the country’s most powerful cable and residential broadband company, they likely feel that they don’t have to really  provide a serious array of public interest commitments.   Even though the broadcasting business is in transition, and film distribution is changing, the sale of NBCU to what is arguably the dominant TV giant isn’t on its own a meaningful public interest benefit.  Indeed, the recent history of media consolidation in the U.S. is one that has actually harmed the public–through cutbacks in news and public affairs, more tabloid programming and higher cable TV rates, for example.

Comcast’s memo today [available via here] says nothing on the key (and crucial) issue of network neutrality and online programming access.  Nor are there any  safeguards for privacy and interactive ads, meaningful concrete funding commitments for local and national news,  and support for truly diverse (non-Comcast/NBCU owned) minority programming.   Today, Comcast demonstrated it’s only fit to perhaps be allowed to operate Comedy Central.

CDD Urges Regulators to Protect Consumer Privacy in Comcast/NBCU deal

The Center for Digital Democracy will ask both the FCC and FTC to ensure that consumer privacy is protected as part of the regulatory review of the Comcast/NBCU partnership.  Comcast is currently deploying interactive TV applications, including for advertising, on its cable systems.   The nation’s largest cable company and broadband ISP  has played a leading role in developing next-generation “advanced advertising” services through the Canoe Ventures interactive TV cable consortium, as well as with CableLabs (Comcast chair Brian Roberts is the chair of the board of CableLabs, the industry’s R&D center).  For advanced advertising, information on household viewing, including from individuals, will be collected from set-top boxes that can be combined with outside databases to form viewer ad targeting profiles.   Highly personal ads will be created, practically instantaneously, for real-time delivery based on these profiles. Cable and other video providers are creating a “real-time decision-making system” for marketing that analyzes user data–including income, ethnicity, and viewing and behavior patterns–to help determine the precise ad to be delivered. Comcast is reportedly planning  “a gigantic database called “TV Warehouse,” able to store a full year of statistics gathered from digital set-tops in more than 16 million households nationwide… having a massive 500 Terabytes of storage, would then feed up to a database even broader in scope operated by Canoe Ventures…”

As the nation’s biggest “video provider” and “largest residential Internet service provider,” Comcast has access to detailed financial information on its TV and broadband subscribers.  It also has a treasure trove of consumer data on viewing behaviors online and with TV.  Comcast can also use its dominate position as the leading high-speed ISP and cable TV provider to extract additional consumer information from its programming partners.   Regulators will need to ensure effective safeguards on network neutrality, programming access and competition, and consumer privacy—especially for “advanced advertising.”

CDD also will ask competition authorities to review Comcast’s relationship with Canoe Ventures, and its implications on content diversity.

Google+AdMob=Mobile Privacy Issues for the FTC. Questions should be raised about mobile targeting via “ethnicity”

The Federal Trade Commission should examine the privacy issues connected to the Google/AdMob deal.  As we informed the FTC yesterday, AdMob says it can target via “age, gender, HHI, ethnicity, education & context.”

The CDD/USPIRG complaint on mobile advertising provides useful analysis. Here’s an excerpt on its discussion about AdMob:

AdMob: “Mining All the Data We’ve Captured”
AdMob is a “mobile advertising network” seeking to “target mobile users and monetize mobile traffic.” There is inadequate notice and little opportunity to opt-out of this data- gathering. Few mobile users realize that their communications and actions are monitored and recorded in order to create intimate profiles for marketing purposes.
AdMob also targets the youth demographic. It segments “market audiences” into several categories, including a “Digital Natives” category, which include boys and girls as young as 13.  AdMob also focuses on social networking sites, claiming it “enables developers to monetize Facebook mobile applications by integrating AdMob’s industry-leading mobile publishing solutions into any Facebook mobile application. Developers building mobile web applications for the Facebook community using the Facebook Platform for Mobile can easily integrate the AdMob code to start serving ads….”

And AdMob is continually seeking to mine and monetize the data gathered on unsuspecting youths and other mobile users. AdMob’s CEO Omar Hamoui admitted, “We are investing a fair amount of development resources into mining all the data we’ve captured over the last 12 months of ad serving and targeting.”

AdMob gathers this data (and targets youths) without adequate notice to the consumer, making it difficult for a mobile user to weigh the costs and benefits and choose whether to opt out of this profiling. This constitutes unfair and deceptive practices, and the Federal Trade Commission should scrutinize these actions.

AAAA Letter to DoJ on Microsoft/Yahoo Deal: `Mad’ Merger Men & Women Missing Some Truth in Advertising

The 4A’S advertising trade and lobby organization sent a letter to the Department of Justice yesterday supporting the Microsoft/Yahoo search merger deal.  Among the five signatories from some of the biggest and most powerful ad companies was the head of the Publicis Groupe. But missing from the `approve this deal’ letter was any acknowledgment that Publicis is a partner of Microsoft–something we and other consumer groups have asked the DoJ to investigate as part of its review.

The recent deal between Microsoft and Publicis includes the sale of Razorfish, combined online ad activities and also data sharing.   In addition, Microsoft is expected to own 3% of Publicis after the deal closes, according to the Wall Street Journal.

The letter to the DoJ should have disclosed this and other conflicts of interest.

Microsoft’s Mobile Behavioral Targeting includes deal with ad giant Publicis

The growing integration of data collection and targeting across key platforms by key online marketing conglomerates, such as Microsoft, with advertising agencies is one issue that policymakers must address.  Here’s an excerpt from a Sept. 21, 2009 announcement on Microsoft’s mobile marketing plans:

Microsoft’s Behavioral Targeting includes Web, Mobile and Xbox

As the debate in Congress, the FTC, the European Commission heats up about behavioral targeting and online privacy–and as regulators examine the Microsoft/Yahoo data deal–here is how Microsoft plans to extend it’s use of behavioral targeting [from MediaPost, excerpt]:

 Microsoft last week began offering behavioral targeting for ads running on its mobile network. But while the service offers a range of online targeted categories — about 100 –to advertisers buying mobile display inventory, the launch really means so much more.

Jamie Wells, Microsoft’s global director of trade marketing, mobile advertising solutions, says the targeting cuts across the Web, mobile and Xbox platforms when consumers sign into their Windows Live account. It allows media buyers to purchase consumer profiles demonstrating interest in specific categories, as well as specific times in a purchase funnel.

The technology doesn’t rely on cookies, but rather the user’s Windows Live ID. Cookies present a challenge on the Web, but even more so on mobile. Sometimes telecommunication carriers either strip out cookies or don’t accept them from third-party companies. So, rather than use cookies, Microsoft relies on behavioral profiles associated with Hotmail email and Xbox accounts through Windows Live ID. When a person on a mobile phone uses that same ID, Microsoft can link the behavior on the Web with behavior on their mobile phone and Xbox.

Although tight-lipped on Microsoft’s strategy, Wells admits “this is just the beginning.” Microsoft plans to expand its approach to tie together the Web, mobile and Xbox, drawing on the power of the entire Microsoft network. The strategy will integrate the audience, he says.

“The mobile application addresses one of the biggest challenges, which is targeting,” Wells says. “This is a way to circumvent the cookie problem and use online profiles. Also, some folks would argue that there’s a much higher bar for ad relevancy on mobile, and BT speaks right to that.”
